Your Instructor

                                                                                                                                               

Your Instructor is a self-employed franchisee ("Your Instructor") of E.W.S.I. Driver Training Team and is not an employee of E.W.S.I Driver Training Team


Driving Tuition / Lessons                                                                                                                                                    


The contract for driving tuition is solely between ‘You’ and Your Instructor. You and Your Instructor are responsible for agreeing all matters relating to the Timing, Location and Duration of Your Lesson(s).


You "Must" notify Your Instructor of any matters which may affect your ability or entitlement to have any in-car driving tuition, for example, but not limited to, any lack, or loss, of a Valid FULL British Driving Licence or a Valid British Provisional Driving Licence.


E.W.S.I. Driver Training Team, acts as an agent for Your Instructor in receiving Your payment(s) for driving tuition, other payments (Cash/Direct Debt or Bank transfer) made directly by You to Your Instructor, are the Responsibility of the Client, where as E.W.S.I. Driver Training Team, makes bookings with, or supplies any information or documentation to you, or processes any payments on your behalf for your lesson(s), they act as the agent of Your Instructor.


Cancellation(s) and Termination of Lessons: Very IMPORTANT                                                                                      

All Clients/ Students MUST READ THE TERMS AND CONDITIONS BEFORE ANY DRIVING TUITION,


A) LEARNER LESSONS,

B) ADI TRAINING PART 1 2 3,

C) TOWING A TRAILER,

D) COOPERATE DRIVER TRAINING

E) ECO DRIVER TRAINING


To Cancel or Alter A) LEARNER LESSONS (s) Minimum of 48 NOTICE MUST BE GIVEN for Cancellations or Alteration of Lesson(s) MUST Be given Directly to Your DVSA Driving Instructor or DVSA Trainer by e-mail, otherwise Your DVSA Trainer will be entitled to charge for the Lesson(s) or tuition concerning Driving lesson(s) that have been booked on to our systems.                                                                                                   


Payments of Fees


Lesson Bookings


We operate a Blocking Booking Service of 10 hours, 20 hours, 30 hours and 40 hours tuition, all fees are to be paid before starting any course with your trainer for all types of training

Your instructor will confirm the Date - Time and Location of Training and will check if you have a valid licence to drive a vehicle and an eye-sight validation test, if these details are not in order before a driving session then we will charge the training for that training session.

   

DVSA Driving Test


Clients should notify their DVSA Driving Instructor if they have a DVSA Driving test in the next coming months ahead with a photocopy of the time, date and location of their "Driving Test" as soon as practicable, and the appointment letter must be emailed to them or given a copy to your DVSA Driving Instructor for verification on the next driving lesson.


No responsibilities will be taken by E.W.S.I. Driver Training Team, for Driving Tests Booked at the times when the DVSA Driving Instructor is unavailable.


Clients will only be allowed the use of the driving school car for a driving test, if the DVSA Driving Instructor agrees that the client is at test standard.


In the interest of " Road Safety and Health and Safety Regulation Acts 2012 "E.W.S.I. Driver Training Team”, reserves the right to withdraw the use of the tuition vehicle for any driving tuition when in the "Instructors" opinion the client is not at test standard or able to drive the Vehicle in a SAFE Manor.


Where the use of the driving school vehicle is withheld for a driving test, the DVSA Driving Instructor will where possible give the client enough notice to enable them to change their booking appointment, this may not always be possible when the course of tuition is of an intensive nature.


No responsibilities will be taken by E.W.S.I. Driver Training Team, for withdrawing the use of the tuition vehicle for any Driving Tuition in their sole discretion the ADI Driver Trainer, assesses the client as not being ready for any DVSA Driving Test or Training Course.

           

Cancellation and Termination of a Driving Test Booking


When a DVSA Driving Test Appointment, is cancelled by the DVSA, all fees still payable in full, unless cancelled in accordance with the normal period of such notice. When the DVSA cancel’s a DVSA Driving Test, because there is No Examiner available it can be possible to claim back any losses incurred by the client, including a proportion of lesson fee's, all forms are online through the DSA web site, this is the responsibility of the client and not E.W.S.I Driver Training Team   

       

When a driving test is cancelled because the client's documents are not in order, the full fees are due to E.W.S.I Driver Training Team for any lesson(s) and the use of the tuition vehicle for the driving test are still payable in full, unless cancelled in accordance with the normal period of notice. To cancel or rearrange a DVSA Driving Test Appointment(s), The client must give 10 days’ notice in advance, to avoid any further disruption too driving tuition and further training courses. In the event that you (the pupil) damage the car during the driving test, where the total repair cost is less than the instructor’s insurance excess, you will be required to pay for the damages to the car.


Late Payments


Lesson fee's and DVSA Driving Tests or Cooperate Tuition are charged at the normal rate of 38% per day for Late Payment of tuition fees’ on the account and an administration fee of £50.00, other costs involved:

Phone calls by mobile or landline - £45.00 per hour

E-mails - £90.00 per hour

Daily rate are £400.00 per day

other expenses incurred i.e. Hotels and travel, this to cover our costs in recovering any fee's outstanding on the account of the said name on the account and other in costs involved.   


Price Changes


The price of a single driving lesson which has been pre-paid as part of a block booking, may be charged at the full rate any time of the booking. You will always receive prior notice of such changes.


The cost of prepaid tuition is based on the lesson price in force at the time of booking and will be honored for 2 weeks after purchase date, thereafter irrespective of any price increase that may occur between the date(s) of booking and when the lesson(s) are taken. Any unused lessons remaining after 5 days that have elapsed, shall have the current lesson price increase applied and is applied for 6 months. 


You "Must" pay for tuition in advance using one of the following methods:

Payment by credit card or debit card by using our on-line Diary System or telephoning customer service at E.W.S.I. Driver Training Team, Payment by cash made directly to Your Instructor.

 

E.W.S.I Driver Training Team, take no responsibilities or liability to you for payments made by other means and further if you do pay Your Instructor directly by cash, you should obtain a receipt. E.W.S.I. Driver Training Team accepts no responsibilities for any payments made direct to Instructors.


Transferability of lessons


You cannot sell or transfer lessons / pupil accounts which have been purchased in Your name to any other person without consent of E.W.S.I. Driver Training Team


Refunds


When a client pays in advance for lesson(s), they shall be entitled to a refund at any time of monies for unused sessions or lesson(s) for accounting purposes this refund will normally be made by Bank Transferred and to the credit card the payment was made on.


Where a discount has been given for the prepayment of lesson(s), i.e. Block Bookings of 10 - 20 - 30 - 40 hours and a refund is requested, the lesson(s) taken by the client will be charged at the full single lesson hourly rate and an administration charged will be applied at £50.00 per hour to cover administration costs, and the balance refunded to the client, after a period of 60 days, once written notice has been given to E.W.S.I. Driver Training Team on line at ewsidrivingschool@gmail.com


Funds paid to E.W.S.I. Driver Training Team for prepaid driving lessons to be provided by your instructor must be  applied to driving lessons by you within six months of the date of your original payment.

 

You acknowledge that after the expiry of this six-month period, you will not be entitled to a refund of any funds not applied to driving lessons or to utilise these funds for booking further driving lessons. If, at any point during this six-month period you determine that you do not wish to take any more of your prepaid driving lessons, you are entitled to a refund of the balance of your funds.

 

You can only pay for driving lessons via the methods outlined above. You cannot pay for driving  lessons via any other method and neither your instructor accepts any liability for monies for lessons paid for by any other method than those outlined above.

 

We do not for example arrange driving lessons through any social media channel or auction site or any other website. Where a partner promotion offers discounted lessons, a promotion code will be provided to enable you to purchase the discounted lessons on our website or through our contact centre. If you are in any doubt about the validity of any offer you find, online or elsewhere, for driving lessons, please contact US for advice.


We do not give refunds, in the following circumstances A) Bad or Adverse Weather Conditions B) Vehicle Mechanical Faults /or Breakdowns before and during training session C) If our trainer is taken ill a short notice


Complaints


If the client is not happy with any aspect of tuition, or of the standard of service offered, they should either raise the matter with their driving Instructor or refer it to our customer service department online at ewsidrivingschool@gmail.com, within 7 days’ notice from the date of cause of the complaint.


Every effort will be made by the driving Instructor / driving school to resolve any complaint or issue, within 60 days of receiving such matters.


Liability


Your Instructor, E.W.S.I. Driver Training Team, are not liable to You for any loss or damage caused where, and to the extent that: There is no breech of a legal duty owed to You by the person or body; such loss or damage is not a reasonable foreseeable result of such a breach; any such loss or damage, or increase in the same, result in any breach or omission by You, any such loss or damage results from circumstances or matters outside of the reasonable control of the relevant person or body Your Instructor, E.W.S.I. Driver Training Team, shall not, in any event, be liable for losses related to any business interests you may have including, without limitation, loss of profit, loss of opportunity or business or business interruption.


You are reminded that E.W.S.I. Driver Training Team, is not party to the contract for driving tuition itself, which is between You and Your Instructor. This does not affect any liability that E.W.S.I. Driver Training Team, may have for any loss or damage You may incur which is caused directly because of any breach (including negligence) by it or them of any legal duty owned by it or them to you.


Nothing in these Terms and Conditions will affect any statutory rights you may have as a customer.


Laws applying to Terms and Conditions


These Terms and Conditions are governed by the laws of England and Wales.
